ANAC 400: Your air passenger rights & compensation in Brazil explained

BRAZILIAN AIR PASSENGER RIGHTS:
You could get up to €1,550 compensation.
Laws cover delays, cancellations, and overbooking.
All Brazilian flights are protected.
A delayed or canceled flight can cost you a lot of money and time, especially if you have to book a hotel for the night or you miss a critical business meeting. And if the airline loses your bags, that will add to the cost.
However, if you’re flying into or out of Brazil, you can receive compensation under Brazilian National Civil Aviation Agency Resolution Nº 400 (ANAC 400) and the Consumer Code. Read on to learn how we can help.
AT A GLANCE
Know your passenger rights in Brazil
Airlines have to compensate passengers for material damages, such as food and hotel costs, if a flight is delayed or canceled.
Passengers can also claim for moral damages: this is money to make up for wasted time, missed opportunities, and/or poor treatment by the airline.
Compensation amounts are not set by law, but in our experience you could receive a total of up to €1,550 per person.
Submit a claim if your flight was delayed over 2 hours, or canceled less than 72 hours before scheduled departure.
Airlines only have to pay compensation if they’re responsible for the delay, e.g., if there was a staffing shortage or technical issue.
Your airline must offer you an alternative flight or a full refund if they cancel your flight.
A delay over 4 hours, A flight time change of more than 30 minutes (domestic) or 1 hour (international) also entitles you to a full refund or alternative flight — if you no longer want the original.
If you have a delayed or canceled flight, receiving the compensation you’re owed can be complicated. AirHelp is here to check how ANAC 400 and the Brazilian consumer code might apply to your situation and make your claim using the strongest arguments available.

Flight compensation under Brazilian law
Passengers may receive up to €1,550 compensation for delays, cancellations and other disruptions under Brazilian laws.
The amount of compensation isn’t fixed, but is based on your individual circumstances. You could end up receiving less — or even more.
AirHelp can help you claim this compensation in the following situations:
| Type of disruption | Eligibility criteria |
|---|---|
| Flight delays | For delays over 2 hours |
| Missed connections | If they delay your arrival over 2 hours |
| Flight cancellations | Especially if you were informed less than 72 hours before departure |
| Flight time changes | If you were told less than 72 hours before departure |
| Denied boarding | Due to overbooking |
The law exists to ensure that airlines are treated fairly as well. When airlines are responsible for the delay – for example, staff shortages or a technical fault – it’s clear that they must be held responsible for any passengers affected.
However, when a delay is caused by circumstances outside of the airline’s control, like a strike by air traffic control or extreme weather, the airline is no longer considered to be responsible. These kinds of events are called extraordinary circumstances.
If your flight is delayed or canceled as a result of extraordinary circumstances, you will still be entitled to care. However, airlines are not expected to provide compensation for events that are outside of their control.
The one important exception to this is if the airline neglects its duty of care. If airlines have ample time to prepare for a disruption, but fail to do so, you can submit a claim for compensation.

On your own
Lots of confusing legal jargon. Air passenger rights regulations are complex.
Lengthy and tricky process supplying paperwork and making calls.
It's expensive to take legal action and you have to pay your lawyer's fee, win or lose.
Smaller chance of success. Airlines may ignore you, or wrongly reject your claim.
We’ll tell you exactly what documents you need based on the airline you were flying with, and we make the process as quick and simple as possible. Typically, we need some form of ID, to prove it was you on the flight, as well as your booking confirmation and boarding passes (mobile or paper).
If you’ve lost or deleted them, don’t worry. We can suggest other ways to obtain the information you need.
If you’re claiming for extra expenses as a result of your disrupted flight, such as accommodations, food, or compensation for a missed event, you’ll also need receipts, invoices, or bank statements to support the charges.
